PRIVACY POLICY

MetroSwap is an online auction service that provides a marketplace for buyers and sellers to find one another and conduct business. In order to bid on or sell merchandise using MetroSwap, you must be a registered MetroSwap user. 

Registration.

The Services and the Web Site are only available to persons with the legal capacity to enter into this Agreement. If you are under the age of 18 and wish to bid for an item on MetroSwap, only your parent or legal guardian may register, place a bid, or purchase the item. MetroSwap may, at its sole and absolute discretion, refuse to accept a person's (or entity's) registration, and may, at any time after accepting registration, refuse to permit a person's (or entity's) continuing use of the Services and the Web Site.

User Information.

User will provide information to MetroSwap during the registration process and to MetroSwap and other Users during the course of the use of the Services and the Web Site (the "User Information"). Additional information beyond the basic registration information may be requested as a qualification requirement to bid on certain asset sales, User agrees to provide such information or it may not be allowed to bid on certain assets. User agrees and warrants: (1) that all User Information is accurate and complete at the time of registration, and (2) that User information will be continuously updated such that the User Information shall at all times be current, accurate, and complete. User grants to MetroSwap a non-exclusive, worldwide, perpetual, royalty-free and irrevocable license to use the User Information, including any associated copyrights, trademarks, or other intellectual property or proprietary rights User may have in the User information, for any purposes in connection with the Services or the Web Site, subject to the terms of the MetroSwap Privacy Policy.

Links to Third Parties.

The Services and the Web Site may provide links to the web sites or services of others ("Third-Party Sites"). Links to such Third-Party Sites do not constitute an endorsement by MetroSwap of such Sites, or the products, content, materials or information presented or made available by such Sites. User acknowledges and agrees that MetroSwap is not responsible for any damages or losses caused or alleged to have been caused by the use of any Third-Party Sites, or from the products, content, material or information presented by or available through such Sites.  


Information Collection and Use Practices.

The first time you place an item up for bid as a seller, or when you engage in multiple auctions as a bidder, MetroSwap will ask you to verify your MetroSwap account with a credit card. In addition to your credit card information, MetroSwap asks for your name, email address, and zip code. You will not be charged a fee for this verification.

All sellers are required to verify their credit card by signing up for a MetroSwap account. MetroSwap uses this information to help prevent misuse of MetroSwap.

The credit card stored in your MetroSwap account is used to bill you on a monthly basis for any applicable listing fees, and we reserve the right to bill your credit card any time during the month (typically monthly), or when your account total reaches $100.

When you bid on an item on MetroSwap, you must enter the amount of your bid and your password. This bid will be publicly available in the auction bid history along with your MetroSwap UserID or alias that you are bidding under.

In the Question & Answer section of each auction, bidders can submit questions for the seller. These questions, the answers, and your MetroSwap UserID or alias will be visible to the public.

When an auction has successfully closed, buyers and sellers are invited to rate one another. All ratings for a buyer or seller are publicly displayed under the "Ratings" tab of a user's Auction Profile. Both parties (the party that was rated as well as the party that did the rating) are identified with their MetroSwap UserIDs and with a link to the auction that they transacted within the rating itself.

If you file a claim, we ask you to fill out a complaint form that asks for information including your name, address, and email address. We use this information to send you and the seller involved in the claim an email encouraging each party to resolve the dispute. The email will contain a link to the complaint that you file. We populate the seller's MetroSwap UserID and email address into the complaint form and the seller is responsible for forwarding this information to MetroSwap. We may also store this information for you in the event that you need to escalate your claim.

We are/will provide an Auction Watch feature that allows users to voice opinions about auctions that do not belong on our auction site. We use this information to decide which auctions should be removed. When you submit an Auction Watch report, we ask for your MetroSwap UserID. This information is not visible to the public and is not made available except under legal demand.

When you create an Auctions Alert, MetroSwap asks you to define what you wish to be alerted about (bids, new auctions in certain categories, etc.) and asks for an email address where your alert should be sent. You can modify or delete alerts at any time from the alerts section of MetroSwap or fro, MetroSwap Alerts.

When you use the "Mail this auction to a friend!" link, MetroSwap will prefill a form with the name and email address we have for you in our records. You enter the email address for the person you want to receive the notice. MetroSwap will use that email address to transmit your message and not for any marketing purposes. Any information you enter will not be retained or transmitted to any third parties.

When you submit a testimonial about your experience on MetroSwap, we will ask for your name, email address, MetroSwap UserID, and information about your experience. If you indicate that we may quote you, your name and experience may be shared with others, and you may be contacted about your experience.

Information Sharing and Disclosure Practices.

When an auction has been completed, MetroSwap will transmit the contact information of the winning bidder to the seller and vice versa so that the parties can complete the transaction.

If you are involved in a claim, MetroSwap may share certain personal information and transactional information with selected partners in order to help facilitate the investigation and resolution of the claim. Our partners may only use this information to process claims and may not use this information for any other purpose.


Practices Regarding Your Ability to Update or Delete Information.

You can edit or delete your Auction settings by clicking on the "My Account" link and then selecting the options under the heading, "Listings" within MetroSwap.
